Customer Purchasing Terms & Conditions

For the following terms of this agreement, any purchaser of  Specialty Solutions Manufacturing Incorporated,

(hereafter known as  SSM Inc.) be they dealers, installers, or otherwise, shall be referred to as “customer”. The customer accepts, understands and agrees to honor all conditions placed forth herewith. These conditions will apply to ALL orders placed by the customer, either in writing, verbally electronically, or otherwise.


Manufacturer’s Warranty: All Products sold by SSM are warranted to be free from defects in material and workmanship for a period of one (1) year from date of shipment.

The customer places all orders in accordance to, and in agreement with the following conditions:

  1. Due to the uncertainty of transportation and labor conditions, SSM, Inc. cannot be responsible for delay in shipment or delays caused by third party carriers.
  2. Replaced materials will be shipped with standard UPS Ground shipping.
  3. Manufacturers’ Warranty applies on products sold unless otherwise stated in writing.
  4. A finance charge of 1½ % per month (18% annual percentage rate) will be added to any balance over 30 days past due.
  5. If placed in the hands of an attorney (by either party) to enforce any rights hereunder, customer agrees to pay all SSM inc. Attorney fees and expenses.
  6. Any legal proceeding shall take place in NY under NY law.
  7. All pricing is in U.S. Dollars.

The foregoing warranty is in lieu of and excludes all other warranties not expressly set forth herein, whether expressed or implied by operation of law or otherwise, including but not limited to any implied warranty of merchantability or fitness for a particular purpose relating to the use or performance of the goods.

Disclaimer: SSM Inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. SSM Inc. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on SSM Inc. or otherwise relating to such materials or on any sites linked to this site. Items on SSM Inc. may not be packaged as shown. SSM is not responsible for variation in product colors.

 Limitations:  In no event shall SSM Inc. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on SSM Inc. even if SSM Inc. or its authorized representative has been notified orally or in writing of the possibility of such damage. In no way shall SSM Inc. and/or its representatives and/or employees be held responsible or liable for any damages incurred or caused by technical or installation support given either verbally, written or via any form of media. All buyers and/or users of products and/or materials found on this site do so at their own risk and SSM Inc. make no guarantee to the outcome of use. SSM Inc. is not responsible for any issues or failures related to moisture or hydrostatic pressure. The customer agrees to determine moisture content of their floor prior to application to determine suitable levels of moisture.

Revisions and Errors:  The materials appearing on SSM Inc. web site or printed materials may contain technical, typographical, or photographic errors. SSM Inc. does not warrant that any of the materials on its web site are accurate, complete, or current. SSM Inc. may make changes to the materials contained on its web site at any time without notice.


Title to Goods: All sales are final at the time of order placement. All orders are final at the time a product order is placed by the customer, regardless of the date of shipment thereafter. However, title to SSM’s products shall pass to the customer upon shipping goods from SSM’s distribution center. All prices are F.O.B. manufacturer’s shipping point unless otherwise stated.


Shipping Claims: The customer must inspect a goods shipment for damages and correctness before signing the delivery receipt. If customer accepts goods without signing a receipt, or verifying the orders, or accepts merchandise by virtue of an employee or surrogate, then all terms and conditions will still apply. In any or all of these situations, SSM cannot be held responsible for damage or shortage if not noted on the delivery receipt.

Any claim by the customer against SSM for damage or shortage must be made to SSM within five (5) days after the customer’s receipt of the goods and must be accompanied by the original bill of lading, signed by carrier, noting the condition claimed. In the event of merchandise being sent by the customer’s shipper, SSM accepts no responsibility for condition of freight received or any losses occurred during transportation.


Product replacement or customer account credit: SSM’s liability is expressly limited to the replacement of defective or damaged goods, or, at SSM’s sole election, to the crediting of the customer’s credit account with an amount equal to the purchase price of such goods, whether such claims are for breach of warranty or negligence.


Cancellation policy: Order cancellation requests can only be sent by email to Order cancellation requests received before processing has begun are refunded in full. If a cancellation request is received after an order has begun processing, but before it has been shipped, a ten percent (10%) restocking fee is deducted from the refund. Orders cannot be canceled once shipped.

Return policy: Returns can only be requested by email to Request must be made within 14 days of the order being shipped. Product must be shipped back within 7 days of return request being accepted. The customer is responsible for returning materials at their own expense. Once returned product is received in good condition, a refund will be issued within 7 days, minus a twenty percent (20%) restocking fee and $32 per box for the original cost of shipping. If product is not received unopened and in good condition within 30 days, a refund cannot be issued. If product is lost or damaged during return shipping, a refund cannot be issued, however a reimbursement may be issued for customer’s shipping costs.


Shipping Terms: All products on our website are shipped by a carrier chosen by SSM Inc. SSM Inc. will notify the customer via email with a carrier tracking or Pro number. It is the responsibility of the customer to ensure that the delivery can be received according to the carrier’s schedule. Any additional delivery fees will be the responsibility of the customer. The carrier may charge the customer directly or they may back charge SSM Inc. for additional charges which will be charged to the customer. SSM Inc. ships all products by regular ground delivery service which generally takes 3-7 business days but could be longer. SSM Inc. may quote shipping times however the customer understands that these times are estimates and not guaranteed. SSM Inc. and or its representatives are not liable for loss due to longer delivery times. The customer authorizes the shipper and delivery company to leave all packages without proof of signature. SSM Inc. is not liable for lost, missing or stolen items. Expedited service may be available for additional fees. Items temporarily back-ordered are shipped immediately upon arrival in our warehouse.


Approved Methods of Payment: Payment in U.S. Dollars is required with the placement of each product order. No order will be shipped without prior payment-in-full for the product. Accepted methods of payment include (I) a Customer’s check up to $5,000.00 on verifiable bank funds (2) bank cashier’s check (3) bank wire transfer (4) approved credit card charge payment (5) utilization of a credit balance from the Customer’s Credit Account at SSM.


The terms and conditions stated above shall be binding upon SSM and the customer, and no change or modification may be made without a signed agreement between the parties.
